This policy (“Privacy Policy”) describes how and why Pledge Financial LLC, and its subsidiaries and affiliated companies or brands (collectively, “Company,” “we,” “us,” or “our”) collect, use, store, disclose, and otherwise process your personally identifiable information (“Personal Information”) when you transact with any Company-owned or operated physical store locations (collectively, the “Stores”), visit the website available at pledgefs.com and any other Company affiliated website (collectively, the “Websites”), use mobile applications offered by the Company (the “Apps”), or engage with us in other related ways (collectively, the “Services”). Certain Company-affiliated Websites may publish additional Website-specific or brand-specific policies (“Supplemental Policies”). Where Supplemental Policies apply, they are incorporated into and form part of this Privacy Policy for that particular Website or brand. In the event of any conflict between this Privacy Policy and the Supplemental Policies, this Privacy Policy shall control.

WHAT INFORMATION DO WE COLLECT?

We also collect information when you contact us for customer support or other inquiries. We use this information to operate and improve our Services and Websites, process and fulfill transactions, communicate with you and respond to inquiries.

Personal Information you disclose to us.

The Personal Information we collect depends on the context of your interactions with us and the Services, the choices you make, and the products or features you use. We receive and store any information you knowingly provide to us when you sign up for our contact lists, make a purchase, submit an inquiry or fill out any online forms. The Personal Information we collect may include the following:

  • payment information (e.g., card type, last four digits, expiration date, tokenized payment identifier) for transactions;

  • any other identifiers which you may voluntarily provide or be prompted to provide in connection with accessing or using the Services.

We also automatically collect certain information when you use our Services, such as your IP address, browser type, device information, operating system, and general location inferred from your IP address. Under many U.S. state privacy laws, an IP address is considered Personal Information, and we treat it as such. We use this information to maintain and secure our Services, for analytics and reporting, and to improve your experience. We may collect more precise location data from your device; if we do, we will first obtain your consent or provide you with the opportunity to opt out as required by applicable law.

We process your Personal Information for a variety of reasons, depending on how you interact with our Services, including:

Sensitive Personal Information.

We may collect government-issued identification for pawn and lending transactions which may be considered “Sensitive Personal Information” under applicable law. We do not sell or share such information. We also do not use or disclose Sensitive Personal Information for purposes that would require offering the right to limit under California law. If this changes, we will provide separate notices and, where required, offer the right to limit use and disclosure. 

Profiling and Automated Decision-Making.

We do not use automated decision-making that produces legal or similarly significant effects without human involvement. 

WHEN AND WITH WHOM DO WE SHARE YOUR INFORMATION?

We may share your Personal Information with third-party vendors, service providers, contractors, or agents (collectively, “third parties”), who may perform services for us or on our behalf and require access to such information to do that work. The categories of third parties we may share Personal Information with include:

WE ARE NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR THE CONTENT OF ANY THIRD-PARTY RESOURCE. We suggest that you contact these third parties directly for information regarding their privacy, security, and data collection and distribution policies prior to providing them with any information. We are not responsible for managing third-party communications; if you no longer wish to receive communications from a third party, please contact that third party directly.

Affiliates. We may disclose Personal Information about you to our affiliates for the purpose of being able to offer you related or additional products and services. Any information relating to you that we provide to our affiliates will be treated by those affiliates in accordance with this Privacy Policy and our Terms and Conditions.

HOW LONG DO WE KEEP YOUR INFORMATION?

We retain Personal Information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, including to satisfy legal, account, or reporting requirements (including applicable state and federal pawn and lending regulations), and then delete or de-identify it consistent with applicable law. We may retain data for longer where required to comply with legal obligations, resolve disputes, or enforce our agreements. 

HOW DO WE KEEP YOUR INFORMATION SAFE?

We use reasonable technical, organizational, and administrative safeguards to protect the Personal Information we process including encryption in transit, access controls, and monitoring. Despite our safeguards, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security. If we become aware of a data breach affecting Personal Information, we will investigate and provide notice as required by applicable law.

DO WE COLLECT INFORMATION FROM MINORS?

The Services are intended for users who are eighteen (18) years or older. We do not knowingly collect Personal Information from anyone under that age. If we learn that we have done so, we will promptly delete it or take steps to de-identify such information as required by law. Pursuant to 47 U.S.C. WHAT ARE YOUR PRIVACY RIGHTS?

Depending on your state of residence, you may have the right to: (a) access your Personal Information; (b) correct inaccuracies; (c) request deletion; (d) opt out of the sale or sharing of your Personal Information and targeted advertising (if applicable); (e) request portability of your Personal Information in a readily usable form; (f) limit the use of your Sensitive Personal Information to purposes authorized by applicable law; and (g) withdraw consent to processing. You may designate an authorized agent to submit a request on your behalf. If you use an authorized agent, we may require proof of authorization and may still verify your identity directly.

GOVERNING LAW

This Privacy Policy and your use of the Websites and Services will be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law rules or principles. Any dispute that is not subject to arbitration or small claims court will be resolved exclusively in the state or federal courts located in New York, New York, and the parties consent to the personal jurisdiction and venue of those courts. Any dispute, claim, or controversy arising out of or relating to this Privacy Policy, the Services, or any data Company collects in connection therewith is subject to the binding arbitration provision set forth in the Company’s Terms and Conditions, which is incorporated herein by reference. By using the Services, you acknowledge and agree that you have read and are bound by that arbitration provision, including the class action waiver contained therein.

SEVERABILITY

If any part of this Privacy Policy is deemed unlawful and/or unenforceable, all other provisions contained herein will remain in full force and effect. 

DO WE MAKE UPDATES TO THIS NOTICE?

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible.
